1. About Prabasi

Prabasi একটি স্বাধীন কমিউনিটি উদ্যোগ, যার উদ্দেশ্য প্রবাসী বাংলাদেশিদের সমস্যা, অভিযোগ, অভিজ্ঞতা ও উদ্বেগ তুলে ধরা, তথ্যভিত্তিক সচেতনতা তৈরি করা এবং প্রয়োজনে উপযুক্ত সহায়তার পথ সম্পর্কে সাধারণ দিকনির্দেশনা দেওয়া।

Prabasi is an independent community initiative intended to help expatriate Bangladeshis raise concerns, complaints and experiences, promote evidence-based awareness, and provide general signposting to appropriate sources of help.

Prabasi বাংলাদেশ সরকার, কোনো দূতাবাস, কনস্যুলেট, আদালত, পুলিশ, আইনজীবী প্রতিষ্ঠান বা সরকারি অভিযোগ নিষ্পত্তি সংস্থা নয় এবং তাদের প্রতিনিধিত্ব করে না।

Prabasi is not the Government of Bangladesh, an embassy, consulate, court, police service, law firm or official complaint-resolution body, and does not represent any of them.

২. ব্যবহারযোগ্যতা ও আপনার দায়িত্ব

এই সাইট ব্যবহার করে আপনি নিশ্চিত করছেন যে আপনার দেওয়া তথ্য বোঝা ও জমা দেওয়ার সক্ষমতা আছে এবং আপনি প্রযোজ্য আইন মেনে সাইট ব্যবহার করবেন। অপ্রাপ্তবয়স্ক ব্যবহারকারীদের ক্ষেত্রে নিরাপদ ও উপযুক্ত হলে বিশ্বস্ত প্রাপ্তবয়স্ক বা অভিভাবকের সহায়তা নেওয়া উচিত।

By using the site, you confirm that you are capable of understanding and submitting the information you provide and that you will use the site lawfully. Minors should consider involving a trusted adult or guardian where safe and appropriate.

3. Complaints, feedback and other submissions

কোনো অভিযোগ বা তথ্য জমা দেওয়ার সময় আপনার জানা ও বিশ্বাস অনুযায়ী সঠিক, সৎ এবং যথাসম্ভব যাচাইযোগ্য তথ্য দিতে হবে। মতামত, অনুমান এবং প্রত্যক্ষভাবে জানা তথ্যের মধ্যে পার্থক্য স্পষ্ট করুন।

When submitting a complaint or other information, you must provide information that is accurate, honest and as verifiable as reasonably possible to the best of your knowledge and belief. Distinguish clearly between facts you directly know, opinions and assumptions.

• ইচ্ছাকৃতভাবে মিথ্যা, বিভ্রান্তিকর বা সাজানো অভিযোগ জমা দেবেন না।
• কাউকে হয়রানি, ভয় দেখানো, অপমান বা প্রতিশোধ নেওয়ার উদ্দেশ্যে সাইট ব্যবহার করবেন না।
• ব্যক্তিগত শত্রুতা বা অসৎ উদ্দেশ্যে কারও পরিচয়, ঠিকানা বা ব্যক্তিগত তথ্য প্রকাশ করবেন না।
• প্রযোজ্য আইন ভঙ্গ করে এমন কোনো বিষয়বস্তু জমা দেবেন না।

• Do not knowingly submit false, misleading or fabricated allegations.
• Do not use the site to harass, intimidate, humiliate or retaliate against anyone.
• Do not expose a person’s identity, address or private information for personal revenge or an improper purpose.
• Do not submit content that is unlawful under applicable law.

৫. প্রমাণ, ছবি ও নথি আপলোড

5. Evidence, images and documents

আপনি যে প্রমাণ আপলোড করেন তা জমা দেওয়ার বৈধ অধিকার বা যুক্তিসঙ্গত ভিত্তি আপনার থাকতে হবে। অপ্রয়োজনীয় পাসপোর্ট নম্বর, ব্যাংক তথ্য, পাসওয়ার্ড, মেডিক্যাল তথ্য বা অন্য ব্যক্তির সংবেদনশীল তথ্য সম্ভব হলে মুছে বা ঢেকে দিন।

You should have a lawful right or reasonable basis to submit evidence you upload. Where possible, redact unnecessary passport numbers, banking information, passwords, medical information and sensitive information about other people.

আপনি আপনার জমা দেওয়া বিষয়বস্তুর মালিকানা বজায় রাখেন। তবে অভিযোগ পর্যালোচনা, সংরক্ষণ, নিরাপত্তা পরীক্ষা, আপনার সঙ্গে যোগাযোগ, প্রাসঙ্গিক বিষয় যাচাই এবং আপনি অনুমতি দিলে উপযুক্ত প্রকাশ/রেফারেলের জন্য Prabasi-কে সেই বিষয়বস্তু হোস্ট, কপি এবং প্রক্রিয়া করার সীমিত, অ-একচেটিয়া অনুমতি দেন।

You retain ownership of content you submit. You grant Prabasi a limited, non-exclusive permission to host, copy and process that content for review, storage, security checks, communication with you, verification, and—where you authorise it—appropriate publication or referral.

৬. পর্যালোচনা, যাচাই ও মডারেশন

6. Review, verification and moderation

Prabasi কোনো জমা গ্রহণ, প্রকাশ বা তৃতীয় পক্ষের কাছে পাঠানোর নিশ্চয়তা দেয় না। নিরাপত্তা, গোপনীয়তা, আইনগত ঝুঁকি, প্রমাণের ঘাটতি, অপব্যবহার বা প্রাসঙ্গিকতার কারণে আমরা কোনো জমা পর্যালোচনা, সীমিত, সম্পাদনা, পরিচয়-গোপন, প্রত্যাখ্যান, সংরক্ষণ বা অপসারণ করতে পারি।

Prabasi does not guarantee that a submission will be accepted, published or referred to a third party. For security, privacy, legal-risk, evidentiary, abuse or relevance reasons, we may review, restrict, edit, de-identify, reject, retain or remove a submission.

আমাদের মডারেশন বা যাচাই কোনো অভিযোগ সত্য বলে আনুষ্ঠানিক সিদ্ধান্ত নয় এবং কোনো ব্যক্তি বা প্রতিষ্ঠানের বিরুদ্ধে আইনি সিদ্ধান্ত হিসেবে গণ্য হবে না।

Moderation or verification by us is not an official finding that an allegation is true and is not a legal determination against any person or organisation.

৭. জনসমক্ষে প্রকাশ ও পরিচয় গোপন

7. Public publication and de-identification

ফর্মে তথ্য জমা দেওয়া মানেই তা স্বয়ংক্রিয়ভাবে জনসমক্ষে প্রকাশের অনুমতি নয়। কোনো ঘটনা সচেতনতামূলক উদ্দেশ্যে প্রকাশ করা হলে, Prabasi প্রয়োজন অনুযায়ী ব্যক্তিগত তথ্য বাদ, সংক্ষিপ্ত, সম্পাদনা বা পরিচয়-গোপন করতে পারে। যেখানে আইন, ন্যায্যতা বা ঝুঁকি মূল্যায়নের কারণে প্রয়োজন, প্রকাশ না করার সিদ্ধান্ত নেওয়া হতে পারে।

Submitting information does not automatically mean you consent to public publication. If a matter is published for awareness purposes, Prabasi may remove, shorten, edit or de-identify personal information as appropriate. We may decide not to publish where law, fairness or risk considerations require it.

Details about how personal information may be collected, used, stored and disclosed are set out in our Privacy Policy. Please read these Terms together with that policy.

১০. সাধারণ তথ্য—আইনি বা পেশাগত পরামর্শ নয়

Prabasi-তে দেওয়া তথ্য, নির্দেশনা, লিংক বা মতামত সাধারণ তথ্য ও সচেতনতার উদ্দেশ্যে। এগুলো ব্যক্তিগত আইনি, অভিবাসন, আর্থিক, চিকিৎসা বা অন্য পেশাগত পরামর্শ নয়। গুরুত্বপূর্ণ সিদ্ধান্ত নেওয়ার আগে উপযুক্ত যোগ্য পেশাজীবী বা সংশ্লিষ্ট সরকারি কর্তৃপক্ষের পরামর্শ নিন।

Information, signposting, links or opinions provided through Prabasi are for general information and awareness. They are not personalised legal, immigration, financial, medical or other professional advice. Obtain advice from an appropriately qualified professional or relevant authority before making important decisions.

১১. তৃতীয় পক্ষের ওয়েবসাইট ও সেবা

11. Third-party websites and services

সাইটে সরকার, দূতাবাস, সহায়তা সংস্থা, সংবাদমাধ্যম বা অন্যান্য তৃতীয় পক্ষের লিংক থাকতে পারে। কোনো লিংক দেওয়া মানে সেই প্রতিষ্ঠান বা তার তথ্যের অনুমোদন নয়। তৃতীয় পক্ষের সাইটের বিষয়বস্তু, প্রাপ্যতা, নিরাপত্তা বা গোপনীয়তা নীতির জন্য Prabasi দায়ী নয়।

The site may link to governments, embassies, support organisations, media or other third parties. A link does not necessarily mean endorsement. Prabasi is not responsible for third-party content, availability, security or privacy practices.

১২. মেধাস্বত্ব

12. Intellectual property

Prabasi-এর নাম, লোগো, সাইট ডিজাইন, নিজস্ব লেখা, গ্রাফিক্স এবং কোড প্রযোজ্য মেধাস্বত্ব আইনে সুরক্ষিত হতে পারে। ব্যক্তিগত ও অ-বাণিজ্যিক ব্যবহারের জন্য সাধারণভাবে সাইট দেখা ও লিংক শেয়ার করা যায়। লিখিত অনুমতি ছাড়া Prabasi-এর ব্র্যান্ডিং ব্যবহার করে নিজেকে Prabasi বা তার অফিসিয়াল প্রতিনিধি হিসেবে উপস্থাপন করা যাবে না।

The Prabasi name, logo, site design, original text, graphics and code may be protected by applicable intellectual-property law. You may generally view the site and share links for personal and non-commercial use. You must not use Prabasi branding to represent yourself as Prabasi or an official representative without written permission.

১৩. সাইটের প্রাপ্যতা ও পরিবর্তন

13. Site availability and changes

আমরা সাইট চালু ও নিরাপদ রাখার যুক্তিসঙ্গত চেষ্টা করি, তবে নিরবচ্ছিন্ন, ত্রুটিমুক্ত বা সর্বদা উপলভ্য থাকার নিশ্চয়তা দিই না। রক্ষণাবেক্ষণ, নিরাপত্তা, প্রযুক্তিগত সমস্যা বা অন্য যুক্তিসঙ্গত কারণে সাইট বা কোনো সুবিধা সাময়িকভাবে সীমিত বা বন্ধ হতে পারে।

We make reasonable efforts to keep the site operating and secure, but do not guarantee uninterrupted, error-free or continuous availability. Features may be temporarily restricted or unavailable for maintenance, security, technical or other reasonable reasons.

আইনে যতটুকু অনুমোদিত, Prabasi সাধারণ তথ্যের ওপর নির্ভরতা, তৃতীয় পক্ষের কার্যক্রম, সাইট অপ্রাপ্যতা, ব্যবহারকারীর জমা দেওয়া মিথ্যা বা ভুল তথ্য, অথবা আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে ঘটনার ফলে সৃষ্ট পরোক্ষ বা ফলশ্রুত ক্ষতির জন্য দায় সীমিত করার চেষ্টা করে।

To the extent permitted by law, Prabasi seeks to limit liability for indirect or consequential loss arising from reliance on general information, third-party conduct, site unavailability, false or inaccurate user submissions, or events outside our reasonable control.

তবে এই শর্তাবলীর কোনো কিছুই প্রযোজ্য আইন অনুযায়ী বাদ দেওয়া, সীমিত করা বা পরিবর্তন করা যায় না—এমন অধিকার, গ্যারান্টি, প্রতিকার বা দায় বাদ বা সীমিত করে না।

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified under applicable law.

১৫. আপনার জমা দেওয়া বিষয়বস্তুর জন্য আপনার দায়িত্ব

15. Your responsibility for submitted content

আপনি আপনার জমা দেওয়া তথ্য ও নথির জন্য দায়ী। আপনার জেনেশুনে মিথ্যা, বেআইনি বা অধিকার লঙ্ঘনকারী বিষয়বস্তু জমা দেওয়ার কারণে যুক্তিসঙ্গতভাবে সৃষ্ট দাবি বা ক্ষতি সম্পর্কে আপনাকে দায় নিতে হতে পারে—তবে কোনো দায় কেবল প্রযোজ্য আইন অনুযায়ী এবং ন্যায্য ও যুক্তিসঙ্গত সীমায় প্রযোজ্য হবে।

You are responsible for information and documents you submit. You may be responsible for claims or loss reasonably caused by content you knowingly submit that is false, unlawful or infringes another person’s rights, but any responsibility applies only to the extent permitted by applicable law and on a fair and reasonable basis.

১৬. এই শর্তাবলীর পরিবর্তন

16. Changes to these Terms

সাইট, আইন বা আমাদের কার্যপদ্ধতি পরিবর্তিত হলে এই শর্তাবলী হালনাগাদ হতে পারে। গুরুত্বপূর্ণ পরিবর্তন হলে এই পৃষ্ঠায় নতুন “সর্বশেষ হালনাগাদ” তারিখ দেখানো হবে। কোনো পরিবর্তন আইনগতভাবে নতুন সম্মতি দাবি করলে, প্রয়োজন অনুযায়ী তা চাওয়া হবে।

We may update these Terms when the site, law or our practices change. Material changes will be reflected by a new “Last updated” date. If a change legally requires fresh consent, we will seek it where appropriate.

১৭. প্রযোজ্য আইন ও বিরোধ

17. Applicable law and disputes

Prabasi আন্তর্জাতিক ব্যবহারকারীদের সেবা দেয় এবং ব্যবহারকারীর অবস্থান অনুযায়ী বিভিন্ন আইন প্রযোজ্য হতে পারে। এই শর্তাবলীর কোনো অংশ বাধ্যতামূলক স্থানীয় আইন বা আপনার বাদ দেওয়া যায় না এমন অধিকারকে অগ্রাহ্য করে না। কোনো বিরোধ বা উদ্বেগ হলে প্রথমে আমাদের সঙ্গে যোগাযোগ করে যুক্তিসঙ্গতভাবে সমাধানের চেষ্টা করতে উৎসাহিত করা হয়।

Prabasi serves users internationally and different laws may apply depending on location. Nothing in these Terms overrides mandatory local law or rights that cannot be excluded. If a dispute or concern arises, you are encouraged to contact us first so that we can try to resolve it reasonably.
